Privacy Notice

Who I am

Joshua Kim MS is the data controller for personal information handled by my office in connection with my work as a Member of the Senedd for Blaenau Gwent Caerffili Rhymni.

My office takes the privacy and security of your personal information seriously.

What information I may collect

I may collect information including:

  • your name and contact details;
  • information you provide when contacting me or asking for assistance;
  • correspondence and information relating to your case or enquiry; and
  • where relevant, sensitive information such as information about your health, ethnicity, religious or political beliefs, trade union membership, sexual orientation, or criminal offences.

I may receive information directly from you, from someone contacting me on your behalf, from organisations involved in your case, or from publicly available sources.

How I use your information

I may use your personal information to:

  • respond to your enquiries;
  • undertake constituency casework;
  • contact organisations on your behalf;
  • represent your views and carry out my duties as an elected representative;
  • maintain appropriate records of my work; and
  • send you electronic updates where you have chosen to receive them.

Information obtained through Senedd-funded constituency work will not be used for party-political or campaigning purposes.

Lawful basis

Personal information will only be processed where there is a lawful basis for doing so.

For constituency casework, processing will generally be connected with my functions as an elected representative. Where sensitive or special category information is required for casework, the relevant basis will usually be that processing is necessary for reasons of substantial public interest.

For some activities, such as electronic newsletters, I will rely on your consent. You may withdraw that consent at any time.

Sharing your information

Where necessary to deal with your enquiry or case, information may be shared with organisations that can assist, such as:

  • local authorities;
  • NHS health boards and other healthcare organisations;
  • Welsh or UK Government departments and other public bodies;
  • the Senedd Commission;
  • other elected representatives where appropriate;
  • organisations providing services to my office; and
  • in limited circumstances, legal advisers, courts or the police.

Only information reasonably necessary for the relevant purpose will be shared. Appropriate safeguards are required where other organisations process personal information on my behalf.

How long I keep your information

Personal information will only be retained for as long as reasonably necessary for the purpose for which it was collected.

Casework information will normally be retained while the case is active and for an appropriate period afterwards, after which information will be securely deleted or anonymised where it is no longer required.

Keeping your information secure

My office takes appropriate organisational and technical measures to protect personal information against unauthorised access, disclosure, loss or misuse. Particular care is taken when handling sensitive personal information.

Your rights

Depending on the circumstances, you may have the right to:

  • request a copy of personal information held about you;
  • ask for inaccurate information to be corrected;
  • ask for information to be deleted;
  • ask for processing to be restricted;
  • object to certain uses of your information;
  • withdraw consent where processing is based on consent; and
  • object to the use of your information for direct marketing.

Requests relating to your personal information will normally be dealt with within the applicable legal time limit.

Electronic communications

I will only send electronic marketing or newsletter communications where the appropriate consent has been obtained.

Every such communication will provide an opportunity to unsubscribe, and requests to stop receiving communications will be respected.
